Please read these Terms of Service carefully. They are a legal agreement between you and DXB Creative Co. and govern your use of FilmScout.
FilmScout is operated by DXB Creative Co., a sole proprietorship registered in Alberta, Canada ("FilmScout," "we," "us," or "our"). For all notices, complaints, copyright and abuse reports, and other communications relating to these Terms, contact us at info@getfilmscout.com.
FilmScout is a family movie companion service. It provides timestamped alerts (Skip, Mute, Heads Up, All Clear) about scenes in third-party movies and television content that families may want to be aware of while streaming. FilmScout does not host, stream, transmit, or modify any third-party movie content. We provide only descriptive metadata and timing information about scenes.
FilmScout is a tool. It is not a substitute for parental judgement. Scene timestamps and descriptions are provided on an "as-is" basis (see §11).
You must be at least 18 years old to create a FilmScout account. FilmScout is intended for adults to use as a tool for informing family viewing decisions. Persons under the age of 18 may use the service only with the active supervision of a parent or guardian who maintains the account.
When you create an account, you agree to provide accurate information and to keep that information current. You are responsible for safeguarding your password and for all activity that occurs under your account.
Each account is for the personal, non-commercial use of one adult (see also our Acceptable Use Policy for commercial use).
You may delete your account at any time through Settings inside the app, or by emailing info@getfilmscout.com. We will process deletion within 30 days, subject to limited records retention required by law or for fraud prevention.
FilmScout offers a free guest experience that provides limited access to a selection of sample movies. No payment information is required.
Paid access ("Pro") is available as a monthly or annual subscription, or as a one-time lifetime purchase. Pricing is shown at the point of purchase. On the web, payments are processed by Stripe. In the iOS app, purchases are processed by Apple through your Apple Account (In-App Purchase). We do not store full payment card details.
Subscriptions automatically renew at the end of each billing period at the then-current rate, unless you cancel. You can request cancellation at any time through Settings inside the app or by emailing info@getfilmscout.com. Subscriptions purchased through Apple In-App Purchase are cancelled through your Apple ID subscription settings, not through FilmScout. When you cancel, you keep access through the end of the current paid period; cancellation does not refund the current period.
We do not provide refunds for unused portions of a billing period or for prior periods, except as required by applicable law. Alberta and other Canadian jurisdictions may grant statutory cooling-off rights for new online subscriptions; if such rights apply to your purchase, we will honour them. To request a refund under applicable law, contact us at info@getfilmscout.com. Purchases made through Apple In-App Purchase are refunded by Apple under Apple's own policies; request them at reportaproblem.apple.com.
We may change subscription prices from time to time. We will notify you in advance of any price change affecting a renewal of your subscription, and you may cancel before the change takes effect.
Founder pricing protection. FilmScout Pro is offered at a founder rate of $1.99 per month while that offer is available. If you subscribe at the founder rate and remain continuously subscribed, your monthly price will not increase, even after the standard rate of $4.99 per month takes effect for new subscribers. Cancelling and resubscribing, switching billing intervals, or any lapse in active subscription forfeits the locked price, and the then-current standard rate will apply on resubscription.
All FilmScout software, scene descriptions, scene timestamps, categorizations, design, and brand elements are owned by DXB Creative Co. or used under licence. We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use FilmScout for your own household's viewing decisions in accordance with these Terms and the Acceptable Use Policy.
FilmScout references third-party movies and television content for the purpose of describing scenes. Movie titles, cast information, and similar factual metadata are used as nominative reference. Posters and other rights-managed images, where displayed, are displayed in connection with editorial commentary; if you are a rights holder and believe content has been used inappropriately, please contact info@getfilmscout.com.
FilmScout may let you submit input such as movie requests, feedback, and other suggestions ("User Contributions"). When you submit a User Contribution, you grant DXB Creative Co. a perpetual, worldwide, royalty-free, irrevocable, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, and display that contribution in connection with operating, improving, and promoting FilmScout. You represent that you have the right to grant this licence and that your contribution does not violate any third-party rights.
Some FilmScout content is published on the open web, including the age guides at getfilmscout.com/is, the movie pages at getfilmscout.com/movies, and ScoutScores and tiers. You may quote short excerpts of these public pages, including a verdict or a score, in reviews, articles, social posts, and similar commentary, provided you credit FilmScout and link to the page you quoted. Scores change as movies are rescored, so link rather than restate a number as permanent. This permission does not extend to reproducing a page in full, republishing the scene map or scene descriptions, or assembling our content into a dataset or competing product, which require a separate written licence (see the Acceptable Use Policy).
If you believe content on FilmScout infringes your copyright, please send a notice to info@getfilmscout.com that includes: a description of the work, the location on FilmScout where it appears, your contact information, a statement that you have a good-faith belief the use is not authorized, and your physical or electronic signature. We will respond to valid notices in accordance with applicable law.
Your use of FilmScout is also governed by our Acceptable Use Policy. Violations of the Acceptable Use Policy are violations of these Terms and may result in suspension or termination of your account.
Our collection and use of personal information is described in our Privacy Policy. By using FilmScout you acknowledge our Privacy Policy.
FilmScout describes scenes from movies and television available on third-party streaming services (Netflix, Disney+, Prime Video, and others). FilmScout has no control over those services. The availability of any movie on any service may change at any time. FilmScout's timestamps are based on a reference cut of each movie; some platforms may insert advertisements or trim content, in which case alerts may not align perfectly. The user remains responsible for confirming what is on screen.
Behind-the-scenes videos are played through the YouTube embedded player. By playing these videos you agree to be bound by the YouTube Terms of Service.
We may suspend or terminate your account, with or without notice, if we believe you have violated these Terms or the Acceptable Use Policy, or if continued use of your account would expose us or other users to legal or security risk. We will use reasonable efforts to provide notice when practical.
We may update these Terms from time to time. If we make material changes, we will post a notice at the top of this page with a clear effective date before the changes take effect. Your continued use of FilmScout after the effective date of the updated Terms means you accept them.
FilmScout is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by applicable law, DXB Creative Co. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that scene timestamps will be accurate, that the service will be uninterrupted, that defects will be corrected, or that content will be free of errors. Scene timing depends on community contributions, third-party platform behaviour, and editorial review; users must exercise their own judgement when relying on FilmScout for family viewing decisions.
To the fullest extent permitted by law, DXB Creative Co.'s total aggregate liability arising out of or relating to your use of FilmScout is limited to the greater of (a) the amounts you have paid to FilmScout in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100). In no event will DXB Creative Co. be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, or loss of goodwill, even if advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
You agree to indemnify and hold harmless DXB Creative Co. from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of FilmScout, (b) your User Contributions, (c) your violation of these Terms or the Acceptable Use Policy, or (d) your violation of any rights of any third party.
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of FilmScout will be resolved exclusively in the courts located in Alberta, Canada, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with the Acceptable Use Policy and the Privacy Policy, constitute the entire agreement between you and DXB Creative Co. regarding FilmScout.
